WI Gov. Walker Attempting To Ban Gays Visiting Their Partners In Hospitals

Wisconsin Governor Scott Walker is attempting to ban LGBT patients in hospitals from being visited by their partners. Seriously. He’s tossing around “defense of traditional marriage” talk to justify his bigoted move, but don’t be fooled. This is seriously an attempt to simply rob gays from having their husband or wife visit them in their time of need. The hate in this man’s heart!

Gov. Scott Walker wants Wisconsin to abandon legal defense of a new state law that gives same-sex couples the right to visit partners who are hospitalized.

A Democratic-controlled Legislature, in 2009, approved a new law in which same-sex couples can sign domestic partnership registries with county clerks “to secure some — but not all — of the rights afforded married couples,” the Milwaukee Journal-Sentinel reported.

The law has been challenged by an anti-gay rights group, Wisconsin Family Action, saying the visitation privileges violate an amendment to the state constitution that bans same-sex marriages or similar legal agreements.

Republican State Attorney General J.B. Van Hollen has refused to defend the law, saying he believes the registration procedure violates Wisconsin’s constitution.

“Governor Walker, in deference to the legal opinion of the attorney general that the domestic partner registry . . . is unconstitutional, does not believe the public interest requires a continued defense of this law,” says a brief from Walker, filed by his counsel Brian Hagedorn.

  • to hell with this jerk.  While the law written may violate Wisconsin’s constitution It  is the constitution rather than this basic human right which needs changing.  It sounds like there’s a lot of work to be done in dairy-land.

    Really, REALLY old news here — from August 2009, no less. Here’s the good news: on June 20th of THIS year, 2011, nearly TWO years later, a Wisconsin judge has ruled that the domestic partner registry is indeed constitutional and will stand. END OF STORY. geez….

    You’re right, Deeg–any court case could drag on and on with appeals.My real point is that this story as written is very old news and there have been very good and positive results since then, which could have been included.

    I don’t believe Governor Walker is making this move out of hatred. He’s currying favor with a right-wing constituency, on purely pragmatic grounds. (However despicable some of the outcomes may be for Wisconsin’s minorities.)

    Governor Walker needs to try to focus on something that this country can do to help the economy and stop worrying over things that are not a problem. There are a lot of gay men and women in the military that are fighting for our rights everyday. He post things to his page about prayers to the family of the fallen soldier on his Facebook page and then comes out with this garbage. I can’t believe that we have an American in office that clearly doesn’t like Americans. Get a life Walker and live and let live. This country was founded on freedom. It is why people left England and came here. They didn’t want to have a religion shoved down their throat when they didn’t believe that way. Now you come a long and try to take someones rights from them. I thought you were an American. It doesn’t matter what color you are, where you are from or your family is from, whom you love, where you live, or the religion you serve. It is the CHOICE that America was built on. Read the Constitution and get the picture. I think you have your head stuck up your ass and can’t read. America cannot be ran just the way you want it. If you want tax money from everyone, then I think it is time you wake up and realize that all Americans are paying taxes and that means you are getting gay tax dollars as well. If you can’t except all Americans then I think it is time you leave America.

    Please give the whole story when you post something like this. In June 2011 a lower court found that the registry is not unconstitutional. The ruling will likely be appealed. And saying that he is trying to ban gays from visiting their partners in hospital is not the same as overturning a law that allows it. I’m sure visits will still take place, but they can be denied. I am really not a fan of this sites  frequent sensationalizing. The truth is good enough.

    This is simply discrimination against a class of people whose actions to unite civilly do not detract from anyone’s life in any way. What happened to equal rights? Why would we waste time on this ‘religious definition’ of marriage that Republicans have brought into government. THAT is what’s unconstitutional. The elderly, physically disabled and mentally challenged are their next victims.

    until this reaches the WI Supreme Court and they rule, it can be challenged. Ultimately 1 of 3 things can happen – the Supreme Court can (and likely will) rule, the legislature can repeal the 2009 law (difficult but not impossible), people can push a statewide referendum where the wording of the referendum typically determines the outcome
